Criminological analysis of counteraction to the doping crime

Of course, one of the most topical orientations of modern state regulation in the field of physical culture and sports is the fight against doping. At the same time, in the conditions of criminalization of such illegal acts as inducement to use or use of prohibited substances and methods in relation to athlete, within the framework of the implementation of the state anti-doping policy of Russia, its criminological aspects acquire a special importance. The purpose of this study is to identify the most effective criminological measures for improvement of the state anti-doping regulation. With the help of methods of analysis, synthesis, deduction, induction and statistical observation, a general characteristic of doping crime was given, a set of its main causes and conditions that should be considered in the generation and implementation of the state anti-doping policy was determined. Due to the using of the method of legal modeling, the effectiveness of anti-doping monitoring as a special instrument of support of sports and legal order was substantiated. The author’s definition of this concept was formulated. The characteristic of its criminological mechanism was given. These results were obtained in the framework of the study of official judicial and statistical information, media data, normative legal base, scientific literature. The practical value of the results of the study is determined by the possibility of normative fixation of measures to eliminate or minimize the factors of doping crime, as well as the creation in practice of a centralized system of analysis, forecasting and prevention of relevant criminal acts, that is, anti-doping monitoring. This system involves the implementation of such measures as the collection and analysis of data about law enforcement, the study of the dynamics of doping crimes, the study of sports legal consciousness of subjects of sports relations in terms of their attitude to doping, obtaining and generalization of other indicators necessary for the effective prevention of these criminal attacks.
