Purpose: The study disputes Resolution of the Plenum of the Supreme Court on December 4, 2014 № 16 «On judicial practice in cases of crimes against sexual inviolability and sexual freedom of the person». Methodology: We used a dialectical, historical, legal, logical, systematic, dogmatic and comparative legal methods. Results: The views expressed in this article are the value judgments and recommendations aimed at overcoming the existing difficulties and gaps in law enforcement in relation to crimes against sexual inviolability and sexual freedom of the person. Novelty/originality/value: The scientific value of the article is that it made recommendations for correct qualification of a number of issues which are not regulated in the explanations of the Plenum of the Supreme Court. The originality of the work is determined by a systematic approach to address and solve the problems that have arisen in connection with the adoption of the Resolution of the Plenum of the Supreme Court on December 4, 2014 № 16 «On judicial practice in cases of crimes against sexual inviolability and sexual freedom of the person».
