Mediation in bankruptcy

The author analyzes the reasons for the institution of bankruptcy liquidation orientation in Russia in terms of availability of conflict situations in the procedure. Concludes that it is the presence of conflicts leads to a depreciation of business assets, the elimination of jobs and closing a business. Proposes to use the mediation process in separate disputes in bankruptcy cases. According to the author, it will allow the parties to negotiate an early stage of the procedure of bankruptcy and will reduce conflicts during the bankruptcy.
