After numerous changes the modern criminal legislation is characterized by absence of system and inefficiency. The article analyses the process of approach in criminal and administrative legislation, regression to administrative prejudice. It shows the criminal and administrative sanction's similarities and justifies viability in developing the misdemeanour definition.
