Model of the normative regulation of unfair competition in the legal system of Russia

At the present stage of social and state development, characterized by the extension of legal space and convergence of national legal systems, the unity in the forming of the model of the normative regulation of unfair competition is absent. The author analyzes and compares the four models of legal regulation of unfair competition: 1. based solely on the materials of judicial practice; 2. formed from the provisions of the Antimonopoly law, part of which acts and normative regulation is to prevent unfair competition; 3. educated provisions of law enforcement on the basis of the norms of the civil legislation; 4. based on the norms of the special legislative act. The author notes highly eclectic nature existing in the legal system of the Russian model of legal regulation of relations arising in connection with the suppression of unfair competition. The Russian model of legal regulation is based on the multiplicity of the sources that have differentiated legal effect to the nature and belong to different branches of law. The author argues that the most correct model of the normative regulation of unfair competition in the domestic legal system is mediating examined relations as the provisions of the Civil code The Russian Federation (in relation to introduce the fundamentals of interaction of civil and competition legislation in establishing the acts of unfair competition in the sphere of rights to results of intellectual activity and equated to them means of individualization), and a special law «On prevention of unfair competition», the structure of which must be formed five chapters: General provisions, protection against acts of unfair competition responsibility for their implementation, consideration arising from unfair competition Affairs, final provisions
