The model of supportive behavior in article 76.2. of the Criminal Code of the Russian Federation and voidability of the name of the norm

Introduction: the article discusses features of compensation of damage in a different way as a cause for promoting with court fine. Materials and Methods: the methodological basis of the study is a combination of general scientific and particular scientific methods of cognition: dialectical, dogmatic, semantic, formal logical, methods of analysis and synthesis. The materials were current criminal and criminal procedure laws, use of norms of release from liability, the draft of the Federal Law dated October 31, 2017 “On amendments to the Criminal Code of the Russian Federation and Criminal Procedural Code of the Russian Federation due to the introduction of the concept of criminal offence” legal texts. Results: proposals were formulated to bring the name of the norm in line with the traditions of presentation of incentive norms of chapter 11 of the Criminal Code.
