Modifications of traditional doctrines in corporate cross-border insolvency law: problems and perspectives of implementation

The article concerns the problem of corporate cross-border insolvency regulation in the context of search the optimal theoretical underlying for this purpose. On the basis of foreign scholars experience the author analyses the main traditional doctrines of corporate cross-border insolvency law - Territoriality and Universalism, and their modified versions - Cooperative territoriality and Modified universalism. Also the author investigates the problems and perspectives of implementation of these theories in international law. In conclusion the author summarizes that Modified universalism is the more preferable and perspective theory to implement in the countries of continental legal system.
