Farm produce in stock being a (disputable) criterion of the subject of a contract of procurement

The paper examined an issue that has arisen in law enforcement practice and being disputable in applied studies. The question is whether some farm produce the producer has already disposed of in stock at the time the parties enter into the contract of procurement may be the subject-matter of this agreement. The author explored the reasons of amending the current legislation with regulations on protection of a producer that go beyond the general principles operating while making of contracts. The study made a review of approaches to the issue by various authors and policy of courts in resolving the problem mentioned.
