Directions for improving constitutional control in the Republic of Iraq and the Russian Federation: comparative study

This article examines the directions of development of the constitutional control system in the Republic of Iraq and in the Russian Federation. Both countries faced difficulties in forming the institution of constitutional control and constitutional jurisdiction. The author analyzes in detail the constitutional foundations and legal norms governing the organization and functioning of the Constitutional Court of the Russian Federation and the Federal Supreme Court of the Republic of Iraq, as well as the role of these supreme judicial control bodies in ensuring human rights. The features of their interaction with other public authorities are considered. The emphasis is placed on the procedural aspects of the formation of the judicial body of constitutional control, judicial practice and its impact on the formation of constitutional judicial practice at the national level are analyzed. The current nature of the publication is due to the presented results of a comparative legal analysis of the activities of constitutional control bodies in Iraq and in Russia. These results represent a number of proposals for improving judicial control based on the analysis of an extensive amount of information in the field of theory and practice of constitutional control in comparison with the practice of constitutional control.
