On the inadmissibility of contradictions in the positions of the defense lawyer and the accused in a criminal case

The author analyzes various procedural situations in which the position of the defense lawyer contradicts the position of the defendant and violates the latter’s right to defense. Various recommendations are given to prevent the defense attorney from committing procedural violations that entail negative consequences for both the client and the lawyer himself. The author draws attention to the need for consistency of positions not only on the issue of legal qualification of the act, but also on procedural aspects. Special attention is paid to the issue of the admissibility of a defense attorney taking an alternative position in a criminal case.
