Assignment of punishment for preparation of a crime in case of criminal recidivism

The article analyzes and summarizes the rules of punishment for the preparation of a crime in recidivism. The aggregate coefficient, which facilitates determination of the inferior limit of possible punishment in case of the application of Part 2 of Art. 68 of the Criminal Code of the Russian Federation when sentencing it for preparation of a crime, was calculated. The maximum and minimum penalties for different cases of recidivism are defined. It is deemed that in cases of crimes for which life imprisonment is prescribed, recidivism does not affect the lower limit of the punishment in the case of a completed crime. Nevertheless, when preparing for such acts, the influence of recidivism on the formal minimum of the possible punishment is quite noticeable and entails the need to impose it precisely in the form of deprivation of liberty.
