Deficiencies in the activities of the prosecutor's office in the presence of oversight of the implementation of laws regarding sentencing in the form of restrictions on freedom and proposals for improvement

This work is devoted to the study of shortcomings in the activities of the prosecutor's office in the supervision of the execution of the law in terms of sentencing in the form of restriction of freedom, shape mergeformat and proposals are identified for improving prosecutorial supervision of the enforcement of laws in terms of sentencing in the form of restriction of freedom. The subject of the study is the rule of law, as well as statistical data of judicial decisions. The aim of the study is to identify the shortcomings of the activities of the prosecutor's office in supervising the implementation of laws regarding sentencing in the form of restriction of freedom, as well as the formation of proposals for improvement in the research process, general scientific methods of scientific knowledge were used analysis, synthesis; private methods - comparative legal, systemic and statistical methods of analysis. In the work, the authors reveal the concept of the type of punishment in the form of a restriction of freedom in practical application. In the work, the authors disclose the concept of the type of punishment in the form of a restriction of freedom in practical application and examine statistical data for the period preceding the introduction of the sentence of restriction of freedom 2007-2009 and for the period of active use of this type of punishment by the courts from 2010 to 1 half-year 2019. Conclusions are drawn based on the results of an analysis of the authors of the prosecutor's activity's shortcomings in supervising the implementation of the law in terms of sentencing in the form of restriction of freedom, the authors suggest ways to improve prosecutorial supervision of the enforcement of laws regarding sentencing in the form of restriction of freedom.
