Negation suit as one of the ways to protect the rights of the owner of a garden land plot

This article is devoted to the consideration of the specifics of the application of a negation claim as a special way to protect the violated rights of owners of garden (suburban, «dacha») plots. Analyzing the origins, the subjective composition of the initiators of the negation claim for the purpose of protecting the interests of the owners of garden (dacha) plots, the author also draws attention to the application of the ex officio principle by the court to establish the ity of the transaction on the initiative of the court, and also formulates general rules for the formation of a position when filing a negation claim.
