Negative acknowledgement of the housing rights

The right acknowledgement, as a universal approving method of the housing right protection, can be realized in two types: a positive one and a negative one. The differentiation of the two mentioned types of the right acknowledgement originates from the essence of this protection method, which is expressed in two levels: at the law-making level – as a protection measure defined by the housing legislation as the possibility to state the presence or the absence of the subjective housing right; at the law-enforcement level – as a specific request to state the presence or the absence of the subjective housing right. The three types of the negative acknowledgement of the right of usage are researched: acknowledging the person as the one who lost his right to use the apartment; acknowledging the person as the one who stopped his right to use the apartment; acknowledging the person as the one who did not acquire the right to use the apartment. The general feature of the studied housing right protection methods is the subject whose housing rights need to be protected, i.e. a person who has the right of using the apartment. The conclusion is made about the possibility to qualify the negative right acknowledgement only as referred to the claim for the acknowledgement of the housing right non-acquisition. The subject of the negative acknowledgement is also the right for the forced lodging into the apartment of other persons, which is not given to the family members of the apartment owner and family members of the apartment hirer, with the exception for his infant children. Negative right acknowledgement is also a method of protecting the right to use the common property in the apartment block, and also – of protecting the corporative housing rights.
