Some aspects of repeated test purchases of drugs

This article explores an urgent problem - the assessment of the adequacy of the grounds for conducting repeated test purchases of narcotic drugs. Based on the analysis of the decisions of the Supreme Court of the Russian Federation and the courts of first instance adopted in criminal cases, which featured materials of repeated test purchases of drugs, the author offers possible ways to establish the adequacy of the grounds for their implementation. The author considers some aspects that make it possible to distinguish repeated test purchases from provocation. The point is made that it is necessary to change the domestic operational-search legislation, in terms of the detailed regulation of the content of the provocation in the operational search activities.
