Some of the special aspects of inprisonment sentenses execution

The article is devoted to the analysis of some of the special aspects of the legal and organizational character of such a criminal sentence execution as the supervised release. The significance of the research topic is also determined by the introduction of a new type of the criminal punishment – the supervised release, alternative to the imprisonment. The proposals on the necessity to increase the number of criminal punishment types alternative to imprisonment and the introduction of the punishment in question were justified by many researchers. The author shares this position, because such punishment types as the supervised release have significant advantage over the punishment associated with the convict isolation from the society; and this is discussed in the present work. At the present time, the legislator introduced a new type of punishment – the supervised release. The execution of this punishment is to be performed by a special state body, the criminal execution inspection. The supervised release is imposed by the court and lasts from two months to four years – as the basic punishment for low-gravity and medium-gravity crimes; and lasts from six months to two years as the additional punishment to imprisonment. The essence of the punishment is manifested in limitations set by Article 53 of the Russian Federation Civil Code. It is noted that the court discretion problem is still important when setting freedom limitations for convicts. The contents of the supervised release allows to make a conclusion that this new punishment has something in common with such punishment as corrective and mandatory works and with such criminal measures as probation and suspended sentence.
