Some challenging providing legal protection of trademarks under paragraph 8 of article 1483 of the Civil Code

The article examines some of the issues arising from challenging the granting of legal protection for a trademark in connection with the presence of a person’s right to identity (confusingly similar) brand name. With specific examples showing the position of Federal Service for Intellectual Property and courts in dealing with this type of case. It is noted that the accumulated practice of Federal Service for Intellectual Property and courts rules of paragraph 8 of Article 1483 of the Civil Code of the Russian Federation has already taken into account when considering the relevant disputes Court for intellectual property rights.
