Some features of legal regulation of the status of an advocate in Russia and France

Purpose: Research of the regulation of the legal status of an advocate in Russia and France. Methodology: The formal-legal method and method of theoretical modeling were used. Results: When conducting a comparative analysis of the regulation of legal status of an advocate in Russia and France were investigated such aspects as: education requirements of persons permitted to practise as an advocate, the procedure of obtaining the status of an advocate, citizenship Institute, internships in the legal profession, question about the advocate’s monopoly; rights, duties and responsibilities of an advocate, ethical requirements for carrying out advocate practice, categories of advocates depending on the characteristics of the status. By the author formulated a number of proposals to improve legislation on the status of advocate. Novelty/originality/value: Article possesses the high scientific value as is one of the first attempts to conside a question about further improvement of the Institute of the status of an advocate in the modern legal system of the Russian Federation taking into account the legislative experience of France.
