The right to lay off staff is researched in the article. The question of using common points of labour legislation to medical staff during laying off them from medical organizations is analysed. In particular, decision making on staff redundancy by employee, excluding from the schedule of positions and salaries, competence of senior physician in this sphere are described. Special attention is given to downsizing the hospital attendant staff. Also court practice of medical staff redundancy is considered. All of the aforesaid led to the conclusion that the necessity of special regulation of downsizing of medical staff according to p. 2 art. 81 Labour code of the Russian Federation. The conclusion of reforming labour law sphere in the part of reconstruction the federal act “On fundamental healthcare principles in the Russian Federation” in so far as relevant to set of requirements of structure schedule of positions and salaries and number of employees was made.
