Some problems related to the prosecutor's supervision over the implementation of laws in police intelligence and ways to solve them

Introduction: in the conditions forming and establishing rule of law, violations of various laws are unacceptable, including in the field of criminal intelligence. As you know, the prosecutor’s supervision is obliged to ensure the rule of law, unity and strengthening of the rule of law, protection of human and civil rights and freedoms, as well as protection of the interests of society and the state protected by law, by identifying and eliminating violations of the law over the implementation of laws in the criminal intelligence. But now a number of existing problems, it needs to be improved. Timely detection of problematic issues need require resolution, their consideration and analysis in the development and implementation of a set of measures allows create a solid foundation for the successful implementation of prosecutorial functions. Materials and methods: the results of the study and analysis of legislative and other normative legal acts, legal literature, including scientific publications devoted to the problems of public Prosecutor’s supervision over execution of laws in the criminal intelligence and the collected material practice. In the course of the research, a set of methods was used: dialectical materialism, an integrated approach to solving the problem, a system of general scientific and particular methods of cognition, including: observation, comparison, description, analogy, formal classification, as well as logical techniques and methods of research (analysis, synthesis, induction, deduction). Results of the study allowed the author to summarize the existing problematic issues related to the implementation of prosecutor’s supervision over the implementation of laws in the criminal intelligence and justify them. For our part, we believe that this has focused the attention of the legislator and researchers, primarily in the field of the theory of prosecutor’s supervision, on the need to find ways to solve them. For ease of use, all complex issues that require resolution are conventionally grouped into theoretical, legal, and organizational and methodological problems. Findings and conclusion: currently the problems do not contribute in any way to improving the effectiveness of the prosecutor’s supervision over the implementation of laws in the criminal intelligence. They largely permeate the theoretical, legal, organizational and methodological foundations of prosecutor’s supervision and thus are partly systemic in nature. The introduction of digital technologies into the activities of the prosecutor’s office leave traces. The development and adoption of a set of measures to address problematic issues related to the prosecutor’s supervision of the implementation of laws in the criminal intelligence is an urgent task of these bodies. Only the solution of problems will bring this branch of prosecutorial supervision in line with modern realities. Currently, in order to identify and promptly eliminate any violations of the law and bring the perpetrators to justice compliance with the rule of law in the field of criminal intelligence requires strengthening prosecutorial supervision.
