Issues of order a court fine

Introduction: the article considers disputable issues of court practice of the use of court fine, elucidation of the Plenum of the Supreme Court of the Russian Federation to Article 76.2 of the Criminal Code of the Russian Federation. Materials and Methods: analytical, formal logical, comparative legal methods and the method of generalization of court practice were used. Results: differing approaches of courts in determining a fine emerged, court practice was studied, and suggestions to unify court practice were made. Discussion and Conclusions: the author consider necessary to legislate a list of offences, in the case of which a judicial fine cannot be assigned.
