Certain issues of legal regulation and law enforcement practice in obtaining information on connection between subscribers and (or) subscriber devices in criminal procedure

Introduction: this article reveals the challenges of legal regulation and law-enforcement practice in obtaining information about connections between mobile users and (or) mobile devices as an investigative action, provided for by Article 186.1 of the Code of Criminal Procedure of the Russian Federation. Materials and Methods: in the course of the study, the author used general academic and special methods of cognition of legal reality: analysis, retrospective analysis, comparative legal method, etc. Results: the analysis of the legal regulation and law enforcement practice of obtaining information about connections between mobile users and (or) mobile devices showed that the current criminal procedure rules governing the production of “information and telecommunication” investigative actions are far from perfect. Discussions and Сonclusions: the author has formulated a number of problems that arise in law enforcement in the production of the investigative actions, as well as suggested recommendations for overcoming them, both in terms of interpreting legal norms and their further improvement.
