Illegal conduct of activities on the basis of overdue debts: on the issue of methods of committing a crime

At present, the Russian Federation is undergoing significant changes in the economic, political and social spheres. An integral part of the financial market is the lending market. In Russia, over the past five years, there has been a clear trend towards increasing lending volumes, which in turn contributes to the growth of the population's debt burden. To recover overdue debt, credit institutions, under the terms of an assignment agreement, interact with collection agencies, whose activities are not always carried out within the legal framework, which contributes to the emergence of a new direction of criminal activity in the collection of overdue debt. This article examines the features of the forensic characteristics of crimes committed by employees of collection agencies against debtors and their relatives. As a result of the study, the most significant elements of the forensic characteristics of these types of crimes were identified and their content was examined. Particular attention is paid to the methods of committing crimes. The article also traces possible correlations between the specified structural elements of the forensic characteristics.
