Reducing negative consequences of amnesty in respect of victims' rights and compensation for material losses caused by the crime

Persons who are recognized as victims in criminal cases are entitled to receive compensation for the harm inflicted by the crime and to demand a fair punishment for the perpetrators. The policy of the Russian state in the criminal sphere can not do without the issuance of acts of amnesty. The legislator and authors of draft amnesty decrees ignore the issues of restoring material damage and victims’ rights. As a result, potentially amnestied individuals are not interested in making up losses caused by the crime. The author concludes that the prevention of negative consequences will become possible if persons convicted for committing crimes connected with causing serious harm to health or causing death will be required to obtain the victim’s consent to apply for early parole.
