Innovations of the special part of the Criminal Code of the Russian Federation amid the current geopolitical situation

Introduction: the authors study innovations of the Special Part of the Criminal Code of the Russian Federation, which are largely due to the current geopolitical situation in Russia and abroad which have not yet received proper coverage in the domestic criminal law doctrine. Materials and Methods: the authors studied over 130 federal laws which together reflect not only the quantitative, but also the qualitative characteristics of the amendments in the Special Part of the Criminal Code of the Russian Federation for the period from 2014 to 2023. Their essence is the same as before (1998 - 2014) boil down to the following: the criminalization of acts dominates over their decriminalization; the penalization of acts recognized as criminal - over their depenalization, and the differentiation of criminal responsibility - over its dedifferentiation (unification). Results: the indicated trends acquire a more intensified form of their expression, in particular, the expansion of the scope of administrative prejudice, an increase in the number of special prohibition norms and special types of exemption from criminal liability. In this regard, the article highlights three main thematic areas of the latest changes in the Special Part of the Criminal Code of the Russian Federation, which, taken together, indicate a change in the focus of the legislator's attention from the individual to the state and society. Discussion and Conclusions: at present, there has been a rejection of the previously officially proclaimed idea of the formation of wartime criminal legislation, which means the final consolidation of the status of the main (basic) source of Russian criminal law for the Criminal Code of the Russian Federation.
