The new excuse is just another discomfiture of the Russian legislator?

Purpose: Conceptual legal-technical analysis of the new excuse with judicial penalty by way of the prism of the foreign experience. Methodology: The author used a formal legal method and a comparative-legal method. Results: In the work the conclusion that the new excuse with the judicial penalty presents danger, firstly, for the constitutionals human rights, secondly, for the legal institute of excuses, which is already establishes in the Russian law. Moreover, there are the defects of the legal technique of the new excuse. Finally, the author conclude, that the amendments to the new excuse are unconditionally necessaries. Novelty/originality/value: The value of work consists of the fact that it presents one of the firsts many-sided analysis of the excuse with judicial penalty both itself and in the others excuses’ system.
