About formation of elements of impact on labour relations in the first years of the Soviet state existence

In this article is discussed some problems of social impact of legal subjects on labour relations during formation of the Soviet labour law since 1917 to 1920. The main legal acts about public relations in the sphere of wage labor during this historical period are called. Intrinsic line of the subject possessing possibility of legal influence is existence of the social power comes to light. Forms of impact in the kind of legal and anti-legal are defined. Some aspects of legal and anti-legal impact of the state for labor relations depending on a political environment is allocated. Evolution of legal regulation of labour relations in a context of designated forms of impact is considered. The impact of the state on labour relations in the first year of the Soviet state represented not only legal regulation, but more ideological influence which formed new sense of justice of workers, reflecting the principle of supremacy of their rights over the rights and interests of the employer (employer), and the employer (employer) in the circumstances was under rigid legal and ideological control of associations of workers and the states is proved. The impact of the state on labour relations in the short historical term took place evolution in the first years of existence of the Soviet state from the progressive character which was in legislative fixing of duration of working hours, setting standards about labour protection, systems of the obligatory social insurance expressing, finally, need of restriction of an arbitrariness of the master's power of the employer and directed on formation of new sense of justice of workers, to negative in the period of policy of “military communism” that found the reflection in legal establishment of a duty to work in interests of the state on pain of attraction to legal responsibility, emergence of the anti-legal influence lying behind a framework of the rule of law, but bringing to its violation and deterioration of legal status of workers, especially in the labour protection sphere.
