On the frameworks of environmental law responsibility sanctions

Sanctions of environmental law responsibility are one of the means to prevent environmental violations and to encourage legitimate behavior in the sphere of environmental relations. For just sentencing and for applying incentive measures, legal sanctions committed in terms of legal technology are required. The author analyzes the sanctions of the complex institute of environmental law responsibility. The author's definition of responsibility on the basis of broad positions, including positive and negative aspects of implementation, calls for not only punitive but also encouraging sanctions. The paper analyzes alternative and other sanctions of environmental law responsibility, notes typical shortcomings, which include excessive “enthusiasm” of the legislator's alternatives, and develops the optimal structure for alternative sanctions. The article contains recommendations aimed at improving the current legislation.
