About some features of qualification of plunders with use of computer technologies

Purpose: A research of features of qualification of plunders with use of computer technologies and identification on this basis of the problems and mistakes arising in law-enforcement practice. Methodology: The general, special and private and scientific methods of a research were used (comparative and legal, system and structural, a method of the concrete and sociological analysis of studying of materials of criminal cases and others). Results: In article the controversial issues concerning the legal characteristic and features of qualification of the plunders committed with use of computer technologies are considered. The review of the scientific points of view of experts in the field of criminal law in the matter is given. The errors of application of the criminal law providing responsibility for plunders of a similar look existing in jurisprudence are analysed. Novelty/originality/value: Article has high scientific value and bears in itself the big practical importance. The provisions which are contained in article materials can be used at improvement of the existing criminal legislation of the Russian Federation, when developing new explanations of the Plenum of the Supreme Court of the Russian Federation, in the course of qualification of the considered plunders by law-enforcement bodies and also in activity of all law enforcement agencies participating in fight against plunders of property in the sphere of computer and information technologies.
