On some theoretical problems of dividing the land fund into categories and practising the functions of land managment

At the moment in jurisprudence many problems connected with modernization of management by ground fund are considered. Without applying for general coverage of a problem, the author of article states the position on two local enough questions of the theory of management: to a problem of division of ground fund on a category and classification of functions of ground management. The conclusion that the legislative initiative being in the State Duma about cancellation of categories of the earths can give a negative effect is as a result proved and won't solve objectively existing problems of increase of management efficiency ground fund. For the decision of such problems it is necessary to increase quantity of categories and subcategories of the earths within the limits of existing division of the earths into categories. At the moment there is a further complication of powers of bodies of the public power in sphere of ground management in this connection, simple transfer of such powers as management functions will complicate scientific perception of the validity. It is represented that such classification of functions should be interbranch and decentralized. The author выделяетя following classifications of functions of ground management: regulatory both guarding; the general and special; on use and protection of the earths. Besides, functions of ground management can be subdivided on economic (cadastre conducting, collection of the ground tax), administrative (ground control, reservation, population informing), ecological (monitoring of the earths). Thus some specified functions are "purely ground" (reservation), others act as a part of others (not ground) the state functions (for example, collection of the ground tax - a small part of fiscal function).
