Development collection practices with the state damage their misdeeds

The article analyses the decisions passed by the Supreme Arbitration Court of the Russian Federation that facilitate implementation of the provisions envisaged in Article 53 of the Russian Constitution. This Article stipulates the right of individuals and organisations to a reimbursement from the state for the damage inflicted by the unlawful actions of the state authorities and their officials. Specific examples of court practice confirm the conclusion that the court of last resort is fairly consistent in implementing a policy of establishing the actual responsibility of the state executive authorities for unlawful damage inflicted on individual entrepreneurs and companies.
