About the parity of concepts of legality and legitimacy in the lexicon of lawyers of the Third Reich

Article is devoted to consideration of the sense put in terms "legality" and "legitimacy" by national socialist lawyers. The special place is allocated K. Shmitta's being the main theorist of the right in the Third Reich arguments. Due to use of archival materials comparison of statements of the professor of the Berlin University, Doctor G. Tripelja for the first time is entered into a scientific revolution. Revealed the theme is actual due to an interlacing with a problematic of essence of totalitarianism. The author considers, that the treatment of terms "legality" and "legitimacy" is caused by the sociopolitical order.
