About protection of the rights of the person during pre-investigation check

The results of the pre-investigation check are important in deciding whether to initiative a criminal case or to refuse to initiative a criminal case. Changes and additions made to Article 144 of the Russian Criminal Code in 2013 concerning the protection of individual rights during the pre-investigation check have identified new requirements to law enforcement. The article refers to the right to legal counsel. Judicial practice has shown that the decision to recognize the evidence as admissible or inadmissible may depend on the implementation of these requirements.
