Objectification of facial disfigurement in determining the severity of harm caused to human health

The article considers the issues of a unified approach to determining the severity of harm to health in the formulation “indelible disfigurement of the face”. When establishing disfigurement, the courts are guided by aesthetic and evaluative ideas about the normal appearance of a person based on personal experience. Currently, there is no single approach to the issue of indelible disfigurement of the face, the scientific basis for the use of signs of appearance to determine the severity of harm to health is not applied by the courts. We propose to base the legal qualification of disfigurement on the system of elements and signs of a person’s external appearance, used in the compilation of a verbal portrait, as the most objective.
