The provision forfeit to execution contract obligations in construction

The author discusses problems of legal regulation of relations connected with the use of penalties in ensuring the commitments in the construction. On the basis of materials of court practice and literature review examines the use of legal and contractual penalties, its ability to reduce and shape. Concludes that the rules of the penalty do not take into account the specifics of construction, because it can not guarantee the proper legal regulation of relations in the construction industry.
