Scope of testator legal capacity as the subject of unilateral transaction

The paper analyzes the basic rights and obligations of a testator, as the initiator of unilateral future transaction, which generates certain rights and responsibilities for the heirs designated in his will, after the death of the testator and the opening of the inheritance, to prove the author’s position the examples from judicial and notarial practice are given.
