Guilt ground as the feature of the subjective aspect of the elements of crime in the works of lawyers of the XIX - the beginning of the XX centuries

The article discloses of the views of scientists of the XIX - beginning of the XX centuries G.S. Feldstein, I.Ya. Foinitskiy, N.D. Sergeevskiy, N.S. Tagantsev and V.D. Spasovich on guilt as an integral feature of the subjective aspect of the elements of crime. A comparative analysis of the justification of guilt as psychic attitude of the guilty persons to the offense committed is given. The achievement of the scientists was the fact that the Criminal code 1903 for the first time singled out forms of guilt in the form of intention or negligence, the doctrine of the guilt is like a barometer of the criminal law.
