Public danger as a differentiating legal liability sign of an offenses related to the provision of services that do not meet the requirements of safety on water and air transport

Introduction. In the context of the development of domestic tourism in Russia, the issues related to the safety of transportation and other tourist services provided by water and air transportation are relevant. In practice, it is observed that the more developed the tourist infrastructure in some of Russia's most attractive tourist regions, the greater the number of so-called "grey" carriers that use water and air vehicles for entertainment and tourism purposes without compliance with current legislation. The article presents data on problems faced by enforcement agencies when deciding on whether to initiate criminal proceedings in such cases.
