Public hazard of deliberately false denunciation

Introduction: the article discusses the main features of a deliberately false denunciation from the point of view of its public danger. The purpose of the study is to establish the difference in the consequences caused by the actions of the subject of the crime (conditional division of the consequences into macro- and micro-levels), provided for in Art. 306 of the Criminal Code of the Russian Federation. Special attention is drawn to the motives for committing this crime in order to understand its nature and degree of danger to society. Materials and Methods: judicial practice (sentences), general scientific methods: analysis, deduction, abstraction, synthesis, dialectical, logical, historical and structural-functional; special legal methods: legal (dogmatic), hermeneutical and comparative legal. Results: the author forms two types of consequences from a deliberately false denunciation, the division is based on the degree of public danger. Discussion and Conclusions: based on this, it is proposed to distinguish between a false denunciation of an unknown person for any purpose and a false denunciation of a known person who is obviously found not guilty of the offence.
