The situation of the crime as the main element of the forensic characteristics of crimes in the field of security violations of long-distance passenger transportation

Introduction: The importance of the forensic characterization of crimes is significant enough for the investigation of criminal cases. At the same time, the most significant element of the forensic characteristic of crimes in the sphere of violations of the safety of intercity passenger road transport is the situation of commission of the crime. This element acts as a "support frame" combining all elements of the crime mechanism, which makes direct connections with the trace mechanism. Materials and methods: the normative basis of the study is formed by the Constitution of the Russian Federation, criminal and criminal procedure legislation. The methodological basis of the study was the general dialectical method of scientific knowledge, which is universal, as well as cognitive methods and techniques of observation, comparison, analysis, generalization and description. In addition, methods of generalizing judicial investigation and investigation practices, etc., were used. The results of the study: revealed the characteristics of such a structural element of the forensic characteristic as the situation of the commission of crimes. Conclusions and conclusions: the general circumstances affecting the situation of commission of crimes have been analysed. Typical circumstances are formulated, which together form the situation of commission of crimes of the category of criminal cases under consideration.
