Review of judicial practice in cases of violations of the fire safety requirement

The purpose of the study is to form an idea about the peculiarities of resolving the most controversial aspects of the interpretation of criminal legislation in the field of violation of fire safety requirements. The article uses methods such as analysis, synthesis, deduction, induction, comparative legal analysis, logical structural analysis. The empirical basis of the study was made up of published materials of the practice of the Supreme Court of the Russian Federation, reviews of the practice of courts of general jurisdiction of Russia, the state of crime in the Russian Federation. The presented review of judicial practice makes it possible to systematize the approaches of a law enforcement officer to the interpretation of criminal legislation in the field of violation of fire safety requirements, which can be used to develop directions for improving the legal mechanism for regulating unlawful acts in this area. The novelty of the article consists in identifying the grounds for the development of conflicts in the application of legislation, determining the elements of offenses that criminalize acts, determining the boundaries of the application of positions developed by judicial practice. The author came to the conclusion that it is necessary to update the clarifications of the Supreme Court of the Russian Federation in connection with the dynamically developing relations in the field of fire safety and the practice of legal proceedings.
