Expediency consideration of liquidated damages integration into Russian law in context of FIDIC proformas

The article examines the nature of forecasted damages in English law. The analysis of the Russian judicial practice on the issue of their recovery is carried out. Assessing the feasibility of the normative consolidation of the institution of pre-estimated losses in Russian law, the author comes to the conclusion that there are no necessary prerequisites for this and that there are alternative tools.
