Intellectual property protection in conditions of globalisation

Globalization and internationalization of the world economy have given rise to new forms and methods of intellectual property rights protection. Sustainable economic and cultural development is impossible without restructuring the national system of intellectual property rights protection. All this requires modernization of the national legal system, reformation the institutional structure of the society corresponding to contemporary tendencies of globalization. Intellectual property rights protect innovations and creations and reward innovative and creative activity. Intellectual property rights are international in character and in that respect they fit in rather well with the economic reality of the global economy. Globalization means intensive cooperation in world division labour between mass production and providing of services and high-technolopies and innovations. National borders are becoming more archaic. Many researches consider knowledge economy to be one of the main sources of power and wealth. Globalization opens market for all enterprises and spreads new methodology and instruments, increasing in that way the progress of information technologies. Introduction of the Part IV of the Civil Code of the Russian Federation allowed to systematize the federal legislation on intellectual property. The basis of this system is recognition of subjective intellectual property rights for the results of intellectual activity and the means of individualization (for intellectual property) as exclusive ones. However, they differ from property rights and other material rights because they are intangible, and they differ from personal non-pecuniary rights of authors and other creators of intellectual results by the fact that they become a subject of civil circulation and allow to involve the objects of intellectual property into such circulation. The aim of the paper is to present the institutional preconditions of globalization and to analize the methods of intellectual property protection in the conditions of globalization.
