Organization of terrorists’ activities and participation in such type of activity (art. 205 5 of RF CC): issues of the sanctions justifications

The article is aimed to evaluate the sanctions of introduced into the RF CC Art. 205 5 that provide liability for organizing terrorist activities and participating in such types of activities. The authors highlightens the relations between this article and Art. 282 2 of RF CC which served as its basis. A comparative analysis of the articles as well as practical results of implementation of punishments for organising terrorist activities under Art. 282 2 RF CC in 2009–2011 are presented. The author comes to the conclusion that the sanctions included into a new article do not fully reflect the degree of the social danger of the crimes represented in the article.
