Organizational and legal aspects of conducting an operational search event "Inspection of premises, buildings, structures, terrain areas and vehicles" in the identification and disclosure of crimes related to the illegal sale of drugs

Introduction: the article deals with the organizational, legal and applied features of the operational search activity “inspection of premises, buildings, structures, terrain areas and vehicles” in the identification and disclosure of crimes related to drug trafficking. The article analyzes the concept of this operational search event, the normative legal acts of the Ministry of Internal Affairs of Russia regulating the procedure for its conduct, as well as some court decisions. Materials and methods: the study is based on the study of the norms of the current Russian and foreign operational-search legislation, normative-legal acts of the Ministry of Internal Affairs of Russia, decisions of the Constitutional and Supreme Courts of the Russian Federation, the European Court of Human Rights. The methodological basis of the study was dialectical, comparative legal, statistical, logical and other methods of scientific knowledge, analysis and generalization. Results of the study: the author comes to the conclusion that the concept and essence of the operational search activity “inspection of premises, buildings, structures, terrain areas and vehicles” needs to be improved in regulatory and legislative regulation, methodological recommendations are given for conducting the considered event on crimes in the field of drug trafficking. Findings and conclusions: the author has made proposals for introducing amendments and additions to the Federal Law “On Operational-search Activities” and the Order of the Ministry of Internal Affairs of the Russian Federation No. 199 of April 1, 2014, in terms of the name and legal regulation of the operational-search event “inspection of premises, buildings, structures, terrain areas and vehicles”, the definition of the author's concept of the considered operational-search event is given.
