Grounds for the solidary plurality of debtors: current issues of judicial practice

The author considers some problems of the institute of solidary plurality of debtors. On specific examples, he demonstrates that the concept of a single joint and several obligation leads to undesirable results - to the denial of the possibility of the emergence of solidarity on various grounds, even in the absence of a direct indication of this in the law or contract. Gives arguments that can be opposed to the literal interpretation of the rules on solidary obligations by the courts.
