In article the analysis of the basic sights and theories of the past and the present criticising the copyright law is carried out. P.J. Prudona's doctrine - the most known opponent of the literary property in XIX century is viewed. Views of leading American critics of the copyright law asserting are analyzed that this institute is not compatible to a modern society. The special attention is given to the doctrine of professor L. Lessig.
