Features of additional qualification of the organization of crime

The article considers the qualification of organization of crimes, which is determined by the specificity of criminal-legal regulation of the concept of the organizer. The author notes that an additional qualification of organization of crimes by the principle of organization of committing the crime is based on two circumstances: organization of a crime and committing a crime. Therefore, only the forms of governing crime-committers refer to the supervision of commission of crimes cited in relevant literature. Beyond the commission of crime, supervision of the commission cannot be made. The author comes to the conclusion that the definition of the organizer as a person who created an organized group or criminal community (criminal organization) causes objections due to the fact that, on the one hand, it does not refer to all forms of criminal complicity and on the other hand it gives an impression of being out of the organization of the crime commission.
