Features of economic and legal regulation of civil and labour relations at the labour market

Formation of the labour potential of a company and attracting of human resources is possible both by means of internal sources and with the use of external sources (the labor market). The internal sources may be an additional work load (concurrent professions, jobs), transfer of employees. Application of the external sources means new hires by the conclusion of an employment contract, a civil contract, or outsourcing, as well as its variant - the staff leasing. The outsourcing is a way to optimize the management of primary and secondary (supporting) activities of the company by transferring a part of management or even production duties according to a contract to outside specialized organizations, which execute those duties by involvement of their own professionals. The labour relationship is, above all, a concentrated, coordinated expression of the economic interests of an employer and an employee. Considering that the problems and shortcomings in the legal regulation of the labour relations are of systemic nature, it seems reasonable that the changes in the Labour Code should be based on the principles of market relations and social partnership with the obligatory due regard to the interests of all the parties. The labour legislation should regulate more comprehensively the variety of forms of employment relationship.
