Features of the inheritance of the rights related to the testator's participation in business partnerships, societies and production cooperatives

This article reflects the specifics of legal regulation of the relations related to the inheritance of rights arising in connection with the testator’s participation in business partnerships, societies and production cooperatives. The author considers the mechanism of the implementation of hereditary rights associated with business activities. In addition, the author defines legal features of inheritance of rights, the testator involved in business activities of economic partnerships and societies and production cooperatives. The article highlights the actual problems that arise in practice when inheriting a share (portion) of this participant (member) in the share (charter) capital (property) of the corresponding partnership, society or cooperative. The author notes discrepancy of the standards of the Civil Code of the Russian Federation defining features of the inheritance of rights connected with participation in economic partnerships and societies, production cooperatives as well as the rights connected with participation in consumers’ cooperatives. Some problems of legal regulation of the accession to shareholder’s rights are specified. The conclusion is drawn that the transition of a share or portion as hereditary succession isn't the basis for acceptance of their successors in members of society, partnership or cooperative.
